Terms of Service

This document is a pre-release draft. Its content will be finalized after expert review.

These Terms of Service (the "Terms") set out the conditions for using Origin (the "Service") provided by Tsk Inc. ("we," "us," or "our"). By using the Service, you are deemed to have agreed to these Terms.

Article 1 (Scope and Definitions)

  1. These Terms apply to all relationships between us and users concerning the use of the Service.
  2. "User" means anyone who views or uses the Service.
  3. "Paid Content" means the personality report, the Career Potential Report, the Growth Plan, and any other features provided for a fee.
  4. Details on fees, auto-renewal, and cancellation are as set out in our Subscription Policy and our Legal Notice (Specified Commercial Transactions Act), both of which form part of these Terms.

Article 2 (Description of the Service)

  1. Based on a user's answers to 72 questions, the Service classifies the user's personality tendencies into one of 16 types and one of the subtypes into which each type is divided (four per type), and provides explanations of the results.
  2. As Paid Content, we provide the personality report, the Career Potential Report, and the Growth Plan (an auto-renewing subscription that provides daily training and progress tracking).
  3. We may change what the Service provides after giving prior notice.

Article 3 (Eligibility)

  1. The Service may be used by anyone who agrees to these Terms and is able to use the Service on their own responsibility.
  2. If you are a minor, please obtain the consent of a parent or legal guardian before using the Service. If a minor applies for a paid service, we will deem that such consent has been obtained.

Article 4 (Accounts)

  1. Accounts for the Service are authenticated by a link sent to your email address (a magic link). Passwords are not used.
  2. You are responsible for managing your email address and the environment in which you receive email. If third parties can read your email, your report may be seen by them.
  3. If the email address you registered is incorrect, you may be unable to receive your report or log in.

Article 5 (Fees and Payment)

  1. The fees, payment timing, and payment methods for Paid Content are shown on the final confirmation screen of your order, on our Pricing page, and in our Legal Notice (Specified Commercial Transactions Act).
  2. Payments are processed through the services of Stripe, our payment processor, and we do not store card numbers.
  3. All amounts shown include consumption tax.

Article 6 (Trial Period and Auto-Renewal)

  1. Your first payment includes a trial period of the Growth Plan. If you do not cancel by the last day of the trial period, the Growth Plan will continue automatically and fees will be charged at the specified billing interval.
  2. The auto-renewal terms (price, billing interval, number of trial days, and how to cancel) are shown on the final confirmation screen of your order and in our Subscription Policy.

Article 7 (Cancellation)

  1. You may cancel the Growth Plan at any time from "Account & Billing" in My Page.
  2. If you are unable to cancel, for example because you cannot log in, please contact us through our contact form.
  3. After you cancel, you may continue to use the Growth Plan until the end of the period you have already paid for.

Article 8 (Refunds)

Due to the nature of digital content, we generally do not offer refunds once access has been provided. Exceptions are set out in our Subscription Policy.

Article 9 (Prohibited Conduct)

When using the Service, you must not engage in any of the following:

  • Conduct that violates laws, regulations, or public order and morals
  • Copying, reposting, redistributing, or selling Paid Content, or any secondary use without permission from the rights holder
  • Collecting the Service's questions, reports, illustrations, or other materials without permission (including through automated access)
  • Unauthorized access, probing for vulnerabilities, or placing an excessive load on our servers
  • Entering another person's email address without permission, or impersonating others
  • Conduct that infringes the rights or interests of us or any third party

Article 10 (Intellectual Property)

  1. All rights in the Service's questions, report text, illustrations, screen designs, programs, and other works belong to us or to their rightful owners.
  2. You may use Paid Content only for your own personal, private use.

Article 11 (Nature of the Results and Disclaimer)

  1. The results provided by the Service are information to support self-understanding. They are not a medical or psychological diagnosis and may not be used to determine any illness, to certify abilities, or to make hiring decisions.
  2. The training in the Growth Plan does not guarantee any improvement in intelligence, abilities, or performance.
  3. We are not responsible for the outcomes of any decisions or actions taken based on the results.

Article 12 (Changes to or Suspension of the Service)

  1. We may change the content of the Service or stop providing it.
  2. We may temporarily suspend the Service without prior notice due to maintenance, system failures, natural disasters, or other unavoidable circumstances.
  3. If we discontinue a paid service that is currently being provided, we will give notice a reasonable period in advance and, where necessary, take measures corresponding to the period for which the service was not provided.

Article 13 (Personal Information)

We handle personal information as set out in our Privacy Policy.

Article 14 (Changes to These Terms)

  1. We may change these Terms as necessary.
  2. If we make changes, we will post the revised content and its effective date on this page. For changes that significantly affect users, we will also notify you by email or other means and, where necessary, obtain your consent again.
  3. Records of consent are stored together with the version of the Terms in effect at the time you consented.

Article 15 (Governing Law and Jurisdiction)

  1. These Terms are governed by the laws of Japan.
  2. Any dispute relating to the Service shall be subject to the exclusive jurisdiction, as the court of first instance, of the Tokyo District Court.
